The seller, whose sale is annulled because of his bad baith, can always obtain the reimbursement of the price  but he cannot claim any indemnity for the  occupation of the property until the annulment if the buyer was acting in good faith (Cass. Civ 3rd, December 5, 2024, No. 23-16.270).
In this case, two people acquired a residential property by deed of September 15, 2017. In June 2018, following water damage, the buyers sued the sell
ers for nullity of the sale for fraud. The cancellation of the sale was pronounced, resulting in the right for the sellers to obtain a refund of the price. However, they were ordered to pay €20,000 in compensation for the damage suffered by the buyers and were refused the occupancy indemnity that they claimed from the buyers.
